Scope: B2C distance sale of wines and related goods, worldwide where legally permitted.
These Terms comply with EU consumer law, VAT/Excise rules, PSD2/SCA, and 2023 wine e‑label rules. Nothing here limits mandatory consumer rights under EU or local law.
"Consumer" means any natural person acting outside a trade or profession. "Products" means wines and related goods offered on the Site. "Site" means www.belgiumwinestore.eu. "Working day" excludes weekends and Belgian public holidays.
DP Sales BV is the seller and contractual counterparty for orders placed on the Site. Our identity and contact details appear at checkout and in order confirmations, as required by EU consumer law.
3.1 You may order only if it is lawful to purchase alcohol in your delivery country. In Belgium, retail sale is prohibited to under‑16s for beer/wine and under‑18s for spirits; we apply strict verification. Carriers may require adult signature and ID at delivery. Orders failing age verification will be cancelled and product price refunded less actual two‑way shipping once the parcel returns.
3.2 We do not ship to locations subject to export, trade or carrier restrictions and reserve the right to cancel any order impacted by sanctions or local prohibitions.
4.1 Images and label artwork are illustrative. Vintages shown are indicative and may roll without notice.
4.2 Substitutions (opt‑in only). If the ordered vintage or wine is unavailable and you opt‑in at checkout, you authorize us to substitute with the same producer/cuvée in the next available vintage or, if impossible, a comparable wine of equal price and similar style. If you do not opt‑in, we will propose alternatives within 48 hours. If you do not respond, we will cancel and refund to the original payment method as required by law.
5.1 Prices are in EUR. For intra‑EU B2C distance sales we apply OSS destination‑country VAT. For imports into the EU ≤ €150 we may use IOSS; above that, import VAT is collected at the border.
5.2 Excise (alcohol). Within the EU, excise is due in the destination country on B2C distance sales; the consignor (or its tax representative) is liable to register and pay according to national procedures. We comply with Directive (EU) 2020/262 and applicable guidance.
5.3 Non‑EU deliveries. Unless stated otherwise, shipments are DAP (Incoterms 2020): local duties/taxes, customs clearance and any import permits are the recipient's responsibility.
6.1 Payments are processed via Mollie using card and local methods displayed at checkout. We use Strong Customer Authentication under PSD2; your bank may require an extra verification step.
6.2 Orders ship only after authorization and risk checks. We may refuse or cancel where fraud or underage purchase is suspected.
7.1 Your order is an offer. A binding contract forms only when we send a shipping confirmation email. We may decline any order before that (e.g., stock error, legal restriction, age verification failure, manifest pricing error).
7.2 Availability and allocations are limited. We may cap quantities per customer based on order value and account history to protect rare allocations.
8.1 We deliver worldwide where legally permitted to the countries offered at checkout. No PO Boxes. Adult signature/ID may be required.
8.2 Temperature holds. To protect quality, we do not dispatch when origin or major transit hub temperatures exceed 26°C. We monitor conditions and hold shipments automatically; we will inform you of revised dispatch dates.
8.3 Delivery timings shown at checkout are estimates. Standard delivery window: 1–2 weeks from dispatch, subject to customs and local carrier performance. If we cannot deliver within 30 days of order, you may set a new deadline or cancel for a full refund as per the Consumer Rights Directive.
9.1 For consumer deliveries arranged by us, risk passes on physical receipt by you or your adult designee (not the carrier). Title passes on full payment.
9.2 If cartons arrive damaged or show leakage, ask the driver to note it and notify us within 48 hours with photos. Your statutory rights do not depend on this notice; it simply speeds resolution.
10.1 For wines produced on or after 8 December 2023, ingredient and nutrition information is mandatory. Where we use electronic labels (QR), they provide the mandatory particulars without collecting or tracking user data, in line with EU rules.
10.2 Allergen and energy information appears on‑pack and/or via e‑label.
11.1 You have 14 days from delivery to withdraw without giving reasons. Notify us within that period and return goods within 14 days after notice. We refund the product price and the standard outbound delivery charge; premium upgrades are not refunded. You bear the direct cost of return unless we state otherwise. We may withhold refund until we receive the goods or proof of return.
11.2 Exceptions. The CRD withdrawal right does not apply to sealed goods unfit for return once unsealed for health/hygiene reasons (opened bottles) and other Article 16 exceptions. We do not sell pre‑arrivals or en primeur, so the "alcohol deliverable after 30 days" exception is not used.
11.3 Returned bottles must be unopened and in resaleable condition with original packaging, unless you claim statutory non‑conformity.
12.1 You are entitled to goods that conform to the contract. Under Directive (EU) 2019/771, you may request replacement or refund for lack of conformity appearing within 2 years from delivery. For wine, "repair" is not meaningful; remedies are replacement or refund within the Directive's framework.
12.2 Mature/old wines. Many bottles evolve uniquely. For older or rare bottles, we sell them as collectible items regarding organoleptic profile. This commercial statement does not limit your mandatory legal rights where a lack of conformity existed at delivery.
12.3 Goodwill window. Beyond statutory rights, we do not operate an open‑ended "corked" replacement scheme. Any discretionary credit is limited to issues reported within 6 months of delivery, with bottle kept ≥75% full and original closure retained, and is subject to our assessment. This does not affect your legal warranty.
If an item goes out of stock after you order and you did not opt‑in to substitutions, we will propose alternatives within 48 hours. If you decline, or do not respond within 48 hours, we will cancel and refund that line item. Where permitted, you may opt for store credit instead.
Time‑limited, while stocks last. Unless stated otherwise, gift cards/credits are non‑transferable, non‑redeemable for cash, and valid for the period shown at issuance.
We avoid misleading practices. Generic environmental claims like "eco‑friendly" or "green" will only be made where supported by recognised excellence; we use eco‑packaging and will substantiate any related claims in our sustainability disclosures.
We process personal data to fulfill orders, verify age, manage fraud risk, and meet VAT/excise obligations. See our Privacy Policy (GDPR) for legal bases, retention and your rights. Payment data is processed securely by our PSP.
We are not liable for delays or failures caused by events beyond reasonable control, including supply constraints, extreme weather, strikes, carrier disruption, regulatory action, cyber incidents or natural events. If such an event lasts over 30 days, either party may cancel undelivered items for a refund.
Nothing excludes liability for death or personal injury caused by negligence, fraud, or rights that cannot be excluded under applicable law. We are not liable for indirect or unforeseeable losses at contract formation.
Email support@belgiumwinestore.eu. We target a response within 48 hours. For consumers in Belgium, you may use the Consumer Mediation Service (Consumentenombudsdienst / Service de Médiation pour le Consommateur). The EU ODR platform has been discontinued.
The Site serves consumers. Business purchases are handled offline by direct invoice only; different terms apply.
These Terms are governed by Belgian law. The English version controls. Consumers also benefit from any mandatory protections of their habitual residence. Disputes may be brought before the competent Belgian courts, without prejudice to rights to sue in home courts where mandatory consumer rules allow it.
We may update these Terms prospectively. The version shown at checkout when you order applies to that purchase.
